Creative Coffee Chat – General Terms and Conditions

The operator of the Creative Coffee Chat web page (hereinafter referred to as the “Website”) located on the internet domain www.creativecoffee.chat (hereinafter referred to as the “Internet domain”) is:

further referred to as “Creative Coffee Chat”
1. Introduction
1.1. The provider of services is Creative Coffee Chat, who sells:
- tickets (hereinafter referred to as the “Ticket”) for any events organised by Creative Coffee Chat (hereinafter referred to as the “Event”),
- subscription based access to curated program of online and offline events and discounts to regular Events provided by Creative Coffee Chat (hereinafter referred to as the “Membership”),
- online consulting services provided by Creative Coffee Chat (hereinafter referred to as the “Appointment”) through the website,
further referred as the “Services”
1.2. The customer is a natural person or legal entity who purchases Services through the website (hereinafter referred to as the “Customer”).
1.3. The Creative Coffee Chat community is understood to be all people who use Creative Coffee Chat services (hereinafter referred to as the “Community”).
1.4. Member space is understood to be a paywall protected area of the Website (hereinafter referred to as the “Member Space”).
2. Concluding a purchase contract
2.1. The Customer can order Services from Creative Coffee Chat through the website operated on the Internet domain.
2.2. Before confirming the order, the Customer has a link to these GTC, and when sending the order, he confirms his familiarity with and agreement to these GTC.
2.3. By sending the order, the Customer confirms that he had the opportunity to familiarize himself with:
a) the characteristics of the Services he is ordering;
b) the total price that he is obliged to pay to Creative Coffee Chat.
2.4 The contract is concluded upon payment of the price by the Customer.
2.5. After sending the order, it is registered in the website system and at the same time Creative Coffee Chat sends to the Customer's e-mail address an order confirmation with information about the ordered Services and price paid.
2.6. If you’ve created an account (see chapter 8 of these GTC) you can access your order history through your account on creativecoffee.chat website. You can also request the invoices on your orders by writing to support@creativecoffee.chat
2.7. The subject of the contract is Creative Coffee Chat obligation to deliver the correct type and quantity of Services at the agreed price in the quantity required by the Customer and the Customer's obligation to pay the agreed price.
3. Rights and obligations of the contracting parties
3.1. By purchasing Services a legal relationship arises between the Customer and Creative Coffee Chat.
3.2. By purchasing Services, the Customer undertakes to comply with the rules established by Creative Coffee Chat.
3.3. By purchasing a Ticket for the Event, the Customer undertakes to comply with the operating and visiting regulations of the Event venue.
3.4. Creative Coffee Chat reserves the right to change its program, date and venue. By purchasing a Ticket, the customer acknowledges this right of Creative Coffee Chat.
4. Payments
4.1. Payments are processed via our third-party payment provider in the form of a secure payment gateway Stripe which allows clients of any bank at home and abroad, who own a VISA, VISA Electron, MasterCard, Maestro, Apple watch to pay online. 4.2. Recurring payments are processed according to your chosen billing cycle and you authorise our third party payment provider Stripe to charge the subscription fee for the next billing cycle unless you cancel your subscription before the billing date. See 6.1. of this GTC.
4.3. Creative Coffee Chat does not have access to, nor stores your credit card information.
5. Prices
5.1. The seller is not a VAT payer.
5.2. Services prices are outlined on the website and are final at the time of purchase.
5.3. Membership subscription price is final at the time of the first payment and is not subject to change unless the Customer cancels their Membership. If the Customer cancels their current Membership, they will resubscribe at the price valid at the time of the new purchase.
5.4. Creative Coffee Chat reserves the right to update prices. The changes will be reflected on the website.
6. Withdrawal from the contract
6.1. Membership subscription can be cancelled anytime before the next payment cycle through the Customer account settings.
6.2. In case of Ticket purchased for the Event:
In accordance with the provisions of § 1837 letter j) Act no. 89/2012 Coll., Civil Code, as amended, the Customer does not have the right to withdraw from the contract concluded between the Customer and the Creative Coffee Chat in accordance with the provisions of § 1829 of the Civil Code (withdrawal from the contract within 14 days without giving reasons), given that this is a contract for the use of free time and the performance is provided by the entrepreneur, i.e. in this case Creative Coffee Chat as the organizer of the Event, within the specified time.
6.3. Appointment can be cancelled with a full refund no later than 72 hours before the scheduled date.
6.3. If a fraudulent charge is reported, Creative Coffee Chat reserves the right to terminate the Membership.
6.4. Creative Coffee Chat reserves the right to revoke the Membership for violations of Creative Coffee Chat code of conduct as specified in chapter 7 of these GTC.
7. Code of Conduct
7.1. Customer agrees to engage respectfully within the Creative Coffee Chat Community:
- Avoid any harassment, discrimination, or disruptive behavior.
- Follow event-specific rules and guidelines.
8. Customer accounts
8.1. Customer can create an account on the Creative Coffee Chat website.
8.2. Through his account the Customer can access the history of orders, manage active subscriptions, save and update payment methods, passwords, addresses and personal information.
8.3. The creation of the account serves to simplify the customer experience with the Website and does not act as an order of Services.
8.4. Customer data is securely stored by our third party service provider Squarespace.
8.5. Your password is for your personal use only and should be kept confidential. If you allow others to access the account, you agree that such individuals are acting on your behalf and that you are bound by any changes that they may make to the account, including but not limited to changes to the subscription plan. To help maintain control over the account and to prevent any unauthorized users from accessing the account, you should maintain control over the devices that are used to access the service and not reveal the password or details of the payment method associated with the account to anyone. You agree to provide and maintain accurate information relating to your account, including a valid email address so we can send you account related notices.
9. Membership account use
9.1. Creative Coffee Chat Membership is subscription-based service which provides its Members access to its members only program for the duration of their subscription.
9.2. Membership access does not create an obligation to participate. We do not offer refunds or credits for missed events or unused discounts.
9.3. Memberships are personal and non-transferable. Members may not share, sell, or transfer their membership benefits to others.
9.4. Unless otherwise noted in Event material, only Members may join Member program Events.
9. Privacy & Data Protection
9.1. By using the website Customers consent to the collection and use of personal data as outlined in our Privacy Policy.
9.2. We will not sell or share Customer data with third parties without consent, except as required by law.
10. Intellectual Property & Content Usage
10.1. Creative Coffee Chat content is understood as any texts, images, photographs published on the Website, newsletters, event printed materials and presentations, or verbally shared during events (hereinafter referred to as the “Content”).
10.2. Content shared within Creative Coffee Chat is subject to copyright and is for personal use only.
10.3. Customers may not reproduce, distribute, or commercially exploit Creative Coffee Chat content without written permission.
11. Final provisions
11.1. The Customer declares that he has familiarized himself with these GTC and undertakes to comply with them.
11.2. The Creative Coffee Chat reserves the right to change these GTC. The GTC or its changes are valid and effective from their publication on the Creative Coffee Chat website. Legal relationships arising from the purchase contract are always governed by the general terms and conditions effective at the time of the binding order of the services.
11.3. This agreement is governed by the laws of the Czech Republic.
11.4. All disputes arising from the purchase of Services from Creative Coffee Chat will be resolved in the general courts of the Czech Republic, unless they are resolved out of court.
11.5. If any provision or provisions of these GTC shall be held to be invalid, illegal, or unenforceable, the validity, legality and enforceability of the remaining provisions shall remain in full force and effect.
11.6. These GTC enter into force and effect on 15.02.2025
